Terms of Service

Effective August 5, 2026

1. Acceptance

By accessing or using the InPsychNow™ platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms constitute a binding legal agreement between you and ASA Family Investments LLC (d/b/a InPsychNow) (“Company,” “we,” “us,” or “our”).

2. Description of Service

InPsychNow™ is a personal productivity and wellness platform that uses your DISC behavioral profile, purpose data, and optional planetary ephemeris data to surface operating-mode recommendations, scheduling insights, and personal development content. The Service is designed for personal productivity, professional development, and general wellness awareness. It is not a healthcare service, clinical tool, or employee assessment instrument.

3. Not a Medical Device: Important Notice

InPsychNow™ IS NOT A MEDICAL DEVICE as defined under Section 201(h) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. § 321(h)) or any comparable state or international law. The Service does not diagnose, cure, treat, mitigate, or prevent any disease, disorder, or health condition. No feature of the Service, including but not limited to HRV logging, Voice Check, DISC assessment, Day Oracle™, SELF OS™, Ba Zi timing, or Wellness Council, is intended to be used, or should be construed as, a medical instrument, clinical diagnostic tool, or substitute for professional medical advice.

The fact that the founder of InPsychNow™ holds a medical license does not confer any medical oversight, clinical supervision, or physician-patient relationship upon your use of this Service. Using this Service does not create a physician-patient relationship of any kind.

If you have concerns about your physical or mental health, consult a qualified, licensed healthcare professional. Do not delay or disregard professional medical advice because of anything you read or receive through this Service.

4. DISC Assessment: Non-Diagnostic, Non-Clinical

The DISC behavioral assessment offered through InPsychNow™ is a self-reported productivity and communication tool. It is not a psychological evaluation, clinical personality assessment, or diagnostic instrument. It has not been validated for clinical, therapeutic, employment selection, or legally protected classification purposes under the Americans with Disabilities Act, Title VII of the Civil Rights Act, or any equivalent law. DISC results are for personal development awareness only and should not be used as the sole basis for employment, personnel, or clinical decisions.

Features that reference candidates, roles, or teams (including the HR Hiring Toolkit™) provide general, non-validated informational context to help you prepare for conversations. Any hiring, promotion, or personnel decision is made solely by you, at your own discretion and risk, and you are responsible for complying with all applicable employment and anti-discrimination laws, including Title VII and EEOC guidance in the United States or their equivalents in your jurisdiction.

4a. Astrology, Ba Zi, and Metaphysical Content

Astrology, natal chart, moon phase, Ba Zi, Day Oracle™, and related metaphysical features are provided for reflection, inspiration, and entertainment purposes only. They make no scientific, predictive, medical, financial, or legal claims. Do not rely on these features to make health, financial, legal, employment, or other consequential decisions.

4b. Artificial Intelligence and Automated Content

Many outputs are generated by artificial intelligence, including large language models. AI-generated content is produced automatically, is probabilistic, and may be inaccurate, incomplete, or inappropriate for your situation. It is not reviewed by a licensed professional before you receive it, and you rely on it at your own discretion and risk.

To generate this content we send only a limited subset of your inputs to third-party AI providers (Anthropic, Google Gemini, Together AI, DeepSeek, our self-hosted inference, and DeepL). We never send your name, email address, or payment details, and we contractually prohibit these providers from training their models on your identifiable data. DeepSeek is based in China and is never used for users in regions we do not serve. The Service does not use AI to make decisions that produce legal or similarly significant effects about you without meaningful human involvement.

4c. Geographic Availability

The Service is intended for users in the United States and select other countries. It is not offered to residents of the European Economic Area, the United Kingdom, Switzerland, Brazil, China, Hong Kong, Macau, South Korea, or countries subject to U.S. sanctions, and access from those regions is blocked. You may not use a VPN, proxy, or false location to access the Service from an excluded region. If we determine that you are a resident of an excluded region, we may suspend or close your account.

5. Biometric and Wellness Features: Personal Awareness Only

Certain features of the Service allow you to log or review biometric data you collect independently from third-party devices (e.g., HRV readings from Apple Watch, WHOOP, Oura Ring, or Garmin). The Service:

Voice Check analyzes self-recorded vocal delivery for communication coaching purposes only. It does not assess neurological, psychological, or pathological conditions. No audio is transmitted to or retained on our servers.

All biometric and wellness features are for personal awareness and productivity purposes only. They do not constitute medical advice, diagnosis, or treatment recommendations.

6. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials. Notify us immediately at legal@inpsychnow.com if you suspect unauthorized access. You must be at least 18 years of age to create an account.

7. Subscriptions & Billing

Paid subscription plans are billed monthly or annually via Stripe. Founder is offered as a separate one-time lifetime purchase. All fees are in USD and non-refundable except as required by law. You may cancel a subscription at any time; your access continues through the end of the paid period. We reserve the right to change pricing with 30 days' notice.

Paid subscriptions automatically renew at the end of the selected monthly or annual billing period at the then-current rate until you cancel.

Founder Lifetime Access

The Founder Lifetime seat is a one-time purchase at a fixed price with no recurring fees. Seat count is capped and may close at any time.

“Lifetime” means for as long as the Service remains in active operation. The Company reserves the right to modify features and usage limits but will not reduce Founder access below the feature set available at time of purchase. In the event of acquisition, dissolution, or discontinuation of the Service, the Company will use commercially reasonable efforts to provide at least 12 months' notice and transfer or refund remaining value.

InPsychNow™ is built on Cadence Method™ technology. InPsychNow™, Cadence Method™, Cadence Timing™, Purpose Prism™, Self-Lens™, Operating Vitals™, SELF OS™, Day Oracle™, Deep Discovery™, and associated features are trademarks of Harvey Castro, MD MBA. Certain methods and systems embodied in this Service are subject to patent applications currently pending before the United States Patent and Trademark Office (Patent Pending). Nothing in these Terms grants you any license to use our trademarks or patented technology.

10. Privacy

Your use of the Service is also governed by our Privacy Policy. Your behavioral and biometric data is encrypted at rest, secured with row-level access policies, and never sold to third parties. You can export or delete your account at any time from Settings.

Chrome extensions, usage, and quotas

A personal extension account key is a credential for the member who created it. You are responsible for keeping it confidential, promptly revoking a key you believe is exposed, and using the extensions only on content you are authorized to process. You must follow applicable law, workplace requirements, and Google, Gmail, LinkedIn, Chrome Web Store, and other third-party terms.

Cadence Weather Today, Week, and Plan This Moment features use deterministic transit calculations and do not consume an AI allowance. Communication Assistant Analyze and Rewrite use AI models and share the monthly call allowance assigned to the connected subscription plan. Calls are counted by account and calendar month. A limit-exceeded response may pause Analyze and Rewrite until the next monthly reset and may offer an upgrade path. Plan features, allowances, and availability may change prospectively as permitted by these Terms.

Communication-style and personality estimates are probabilistic and may be incomplete, biased, or wrong. They are not diagnoses, verified facts, or professional advice. You may not use an estimate as the sole or determinative basis for hiring, firing, promotion, compensation, credit, housing, insurance, healthcare, education, law enforcement, or another decision that materially affects a person's rights or opportunities. Review every rewrite before sending it. The extension never sends content for you.

Do not submit passwords, authentication tokens, government identifiers, payment-card or financial-account data, health information, privileged material, trade secrets, or other confidential, regulated, or sensitive information. Local model mode sends selected content to the local service configured on your device. You are responsible for that service's security, models, storage, retention, and outputs.

10a. Communications and Notifications

To support a consistent practice, the Service sends periodic engagement notifications by default, including reflection reminders and seasonal or lunar “cadence” prompts, delivered as in-app messages, browser push notifications, and email. These are informational wellness prompts only and are subject to the disclaimers in Sections 3, 5, and 11.

You are enrolled in these notifications by default, and you can opt out at any time. Every notification email includes a one-click unsubscribe link, and you can turn any category on or off from Account → Email Preferences and your notification settings. Transactional messages needed to operate your account, such as billing, security, and password resets, are not affected by these choices.

10b. AI Processing and Submitted Content

When you use an AI-powered feature, you instruct the Company to process the content you submit through its self-hosted inference systems and, when necessary to provide the Service, through the AI providers identified in the Privacy Policy.

Operational systems may temporarily process and retain limited technical records for security, reliability, abuse prevention, and troubleshooting. These records are not intended to serve as your report history. Reports intentionally saved to your private account are governed by the Privacy Policy and the deletion controls provided in the Service.

You must have the right and authority to submit any content you provide. Do not submit protected health information, credentials, confidential client information, trade secrets, financial-account information, or other regulated or sensitive information.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

ALL OPERATING-MODE RECOMMENDATIONS, WELLNESS COUNCIL RESPONSES, DAY ORACLE™ TIMING SIGNALS, SELF OS™ OUTPUTS, HRV CONTEXT, VOICE CHECK METRICS, DISC PROFILE INTERPRETATIONS, BA ZI TIMING, AND ANY OTHER CONTENT DELIVERED BY THE SERVICE ARE FOR PERSONAL PRODUCTIVITY AND GENERAL WELLNESS AWARENESS ONLY. THEY DO NOT CONSTITUTE MEDICAL, PSYCHOLOGICAL, PSYCHIATRIC, NUTRITIONAL, FINANCIAL, OR LEGAL ADVICE OF ANY KIND, AND SHOULD NOT BE RELIED UPON AS SUCH.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ASA FAMILY INVESTMENTS LLC (D/B/A INPSYCHNOW), ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to defend, indemnify, and hold harmless ASA Family Investments LLC (d/b/a InPsychNow) and its officers, directors, employees, contractors, agents, licensors, and successors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use or misuse of the Service; (c) your violation of any third-party right, including any intellectual property right or privacy right; (d) any claim that content you submitted caused damage to a third party; or (e) your use of the Service in a manner inconsistent with its intended purpose, including any use as a clinical, diagnostic, or medical-decision-making tool.

14. Mandatory Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Binding Arbitration. Except for claims that may be brought in small claims court, you and Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including the validity, enforceability, or scope of this arbitration clause) shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court. Arbitration shall be conducted in Dallas, Texas. The arbitrator shall have authority to award the same damages and relief as a court of competent jurisdiction, except as otherwise limited by these Terms.

Class Action Waiver. YOU AND COMPANY EACH AGREE THAT ANY PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND COMPANY EACH WAIVE ANY RIGHT TO A JURY TRIAL. YOU ALSO AGREE THAT YOU MAY BRING CLAIMS AGAINST US ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

Opt-Out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to legal@inpsychnow.com with the subject line “Arbitration Opt-Out.” If you opt out, all other provisions of these Terms remain in full force and effect.

15. Termination

We may suspend or terminate your access for material breach of these Terms, at our sole discretion, with or without notice. You may delete your account at any time from Settings. Upon termination, your data may be retained for up to 30 days before deletion, except where longer retention is required by law. Sections 3, 4, 5, 9, 11, 12, 13, 14, 16, and 17 survive termination.

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. To the extent any matter is not subject to arbitration under Section 14, the parties consent to exclusive jurisdiction and venue in the state and federal courts located in Dallas County, Texas.

17. Changes to These Terms

We may update these Terms at any time. For material changes, we will provide at least 14 days' notice via email or in-app notification before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account before the effective date.

Laws, regulations, safety evidence, technical standards, or provider requirements may change. To protect users and comply with applicable obligations, we may modify, restrict, suspend, replace, or remove a feature, model, data use, or geographic availability. When reasonably practicable, we will explain material user-facing changes and preserve access to unaffected account functions.

If you believe a feature or output may violate a law, right, safety standard, or these Terms, please use our AI concern reporting process.

18. EU/EEA Supplemental Terms

If you are located in the European Union, European Economic Area, or the United Kingdom, the following supplemental terms apply in addition to the Terms above. In the event of any conflict between these supplemental terms and the Terms above, these supplemental terms shall prevail for EU/EEA/UK users.

18.1 Right of Withdrawal

Under the EU Consumer Rights Directive (2011/83/EU), you have the right to withdraw from a distance contract within 14 days of the date of the contract without giving any reason. To exercise this right, contact us at legal@inpsychnow.com with a clear statement of your withdrawal. If you have already used the Service during the withdrawal period, you may be required to pay a proportionate amount for the service received.

18.2 Data Protection

Your personal data is processed in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and UK GDPR. Harvey Castro, MD MBA is the data controller. You have the right to access, rectify, erase, restrict, port, and object to the processing of your personal data. See our Privacy Policy for full details. You can manage your consent preferences at any time via your Privacy & Data settings.

18.3 Dispute Resolution for EU Consumers

The mandatory arbitration clause in Section 14 does not apply to consumers in the EU/EEA/UK to the extent that it conflicts with mandatory consumer protection laws in your country of residence. If you are an EU consumer, you may bring proceedings in the courts of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

18.4 Limitation of Liability for EU Consumers

The limitation of liability in Section 12 applies to the maximum extent permitted by applicable EU/EEA/UK consumer protection law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

18.5 Governing Law for EU Consumers

If you are an EU consumer, these Terms shall be governed by the laws of your country of habitual residence, to the extent that mandatory consumer protection provisions of that country provide more favorable protection. This does not affect the application of Texas law to all non-consumer matters.

19. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Company regarding the Service and supersede all prior agreements. If any provision of these Terms is found unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force. Our failure to enforce any provision shall not constitute a waiver of our right to enforce it in the future. You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

20. API Access

API access is subject to these Terms. API keys are non-transferable and tied to your account. You may not exceed published rate limits, resell API access, or use the API for bulk data extraction. We reserve the right to revoke API access for abuse or violation of these Terms.

21. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, or internet service disruptions.
